Terms of Service
These terms govern your use of the TrakJaks app and website. By creating an account or using the service you agree to them. If you do not agree, do not use TrakJaks.
1. What TrakJaks is — and is not
TrakJaks is a record-keeping and community app for casino wins. It is not a gambling service. It does not accept wagers, pay out winnings, or facilitate gambling of any kind. Nothing in the app is advice about whether, where, or how much to gamble. Gambling involves risk; if it is causing you problems, help is available at 1-800-GAMBLER (1-800-426-2537) in the United States.
2. Eligibility
You must be at least 21 years old and legally permitted to be present in a casino where you are. By using TrakJaks you represent that this is true. We may suspend or remove accounts that we reasonably believe belong to anyone under 21.
3. Your account
Accounts start anonymous and are tied to your device until you link a sign-in method. You are responsible for activity on your account and for keeping your device secure. One person, one account. Accounts may not be sold, transferred, or shared.
4. Your content
You own the photos and information you add. By sharing a win to the community you grant us a non-exclusive, worldwide, royalty-free license to display it within TrakJaks (the feed, rankings, and related features) for as long as it remains shared. Making a win private again ends that display. You also grant us the right to process all content you add in order to run the service, including automated photo analysis.
You agree not to add content that:
- is not yours — for example a photo of someone else's win, or a photo taken from the internet;
- misrepresents a win — an amount, game, casino, or date that is not what happened;
- shows other people in a way that violates their privacy, or shows casino staff, security features, or areas where photography is prohibited;
- contains personal information of others, or your own government identifiers;
- is unlawful, harassing, hateful, or otherwise objectionable.
Casinos set their own rules on photography. You are responsible for complying with them.
5. Rankings and evidence
The community feed and rankings exist to be trusted. We label each win by the evidence behind it, exclude self-reported and duplicate wins from rankings, and use automated checks to detect duplicate photos and inconsistent entries. We may hide any shared win, remove any account from rankings, or suspend any account we believe is misrepresenting wins, without prior notice. Our determination is final for the purposes of the community features.
6. Aggregate data
We may create and license statistics derived from wins logged in TrakJaks that do not identify any user, as described in our Privacy Policy. Individual records, photos, locations, and identities are not part of any such data.
7. Tax records
The ledger and W-2G features help you keep your own records. They are not tax advice, and TrakJaks does not file anything on your behalf or with any authority. You are responsible for your own reporting. Verify figures against the original documents.
8. Acceptable use
Do not attempt to access other users' private data, interfere with the service, circumvent rate limits or evidence checks, use automated tools to create accounts or submit wins, or reverse engineer the app beyond what the law allows.
9. Suspension and termination
You can delete your account at any time. We may suspend or terminate accounts that violate these terms. On termination your right to use the service ends; sections 4, 6, 10, 11, and 12 survive.
10. Disclaimers
TrakJaks is provided "as is" and "as available". Photo reading is automated and can be wrong; you confirm every entry. We do not guarantee that the service will be uninterrupted or error-free, or that any record will be preserved. To the fullest extent permitted by law we disclaim all warranties, express or implied.
11. Limitation of liability
To the fullest extent permitted by law, Lucid Logic LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or winnings, arising from your use of TrakJaks. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim or fifty US dollars.
12. Governing law and disputes
These terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Clark County, Nevada, and you consent to their jurisdiction. If a provision of these terms is found unenforceable, the rest remains in effect.
13. Changes
We may update these terms. We will post the new version here with a new effective date and, for material changes, notify you in the app. Continued use after the effective date means you accept the updated terms.
